General Terms and Conditions of Sale
The goods covered by these general terms are offered for sale by BLUEBEAR ITALIA Srl, with registered office at Corso Monforte, 7 MILANO 20122, registered in the Companies Register, Tax Code/VAT number 12226770969, hereinafter referred to as "BLUEBEAR ITALIA SRL", certified email (PEC): bluebearitaliasrl@cgn.legalmail.it.
1. Definitions
1.1. The term "electronic commerce contract" refers to the contract for the sale of goods and services entered into between BLUEBEAR ITALIA SRL (the e-commerce site operator) and a customer or consumer, within a distance selling system (i.e., without the simultaneous presence of the parties, organized by BLUEBEAR ITALIA SRL, which uses one or more telematic communication tools for this contract).
1.2. The term "Buyer" refers to either the customer (VAT-registered entity) or the individual consumer (as defined in Article 3 of Legislative Decree No. 206/2005, i.e., a person making a purchase for purposes not related to their entrepreneurial or professional activity, if applicable).
1.3. The term "BLUEBEAR ITALIA Srl (or e-commerce site operator)" refers to the entity mentioned above that sells goods or provides services.
2. Object of the Contract
2.1. Under this electronic commerce contract, BLUEBEAR ITALIA Srl sells, and the Buyer purchases remotely via telematic tools, the tangible goods or services listed and offered on the website www.inbetweeners.io.
2.2. The goods mentioned above are available on the website www.inbetweeners.io, which displays the catalog of offered products. The products are represented and made visible on the website in an accurate manner corresponding to their actual characteristics. However, BLUEBEAR ITALIA Srl cannot guarantee the exact match between the images and colors displayed on the customer’s monitor and reality. In case of discrepancies between the image and the product description, the product description shall prevail.
3. Technical Steps for Contract Conclusion
3.1. The contract between BLUEBEAR ITALIA Srl and the Buyer is concluded exclusively via the Internet. Once the Buyer accesses www.inbetweeners.io, they must follow the procedures outlined on the website to confirm acceptance of the purchase of the services referred to in Article 2 above.
3.2. Upon receipt of the order acceptance by BLUEBEAR ITALIA Srl, a confirmation will be sent via email, or a confirmation page summarizing the order will be displayed and printable.
3.3. Once payment for the goods has been received, BLUEBEAR ITALIA Srl will issue the relevant fiscal document in accordance with DPR No. 633/1972, where required by law. If the Buyer wishes to receive an invoice, they must request it by emailing customerservice@inbetweeners.io, providing their tax code or VAT number and order number.
3.4. The contract shall not be considered finalized and will be ineffective if the elements mentioned in the previous paragraph are missing.
4. Payment and Refund Methods
4.1. Any payment for goods purchased by the Buyer may only be made using the payment methods indicated on the BLUEBEAR ITALIA Srl website. Using the designated payment methods does not entail any additional costs for the Buyer.
4.2. Any refunds due to the Buyer will be credited using one of the methods proposed by BLUEBEAR ITALIA Srl and chosen by the Buyer, promptly and, in the case of the exercise of the right of withdrawal, no later than 14 days from the date on which BLUEBEAR ITALIA Srl became aware of the withdrawal. BLUEBEAR ITALIA Srl may withhold the refund until the item is received or until the Buyer has provided proof of the return, whichever occurs first.
4.3. All communications related to payments are made over a secure line protected by an encryption system. BLUEBEAR ITALIA Srl ensures the storage of such information with an additional level of security in compliance with applicable data protection laws.
5. Delivery Time and Methods
5.1. BLUEBEAR ITALIA Srl will deliver the selected and ordered products without undue delay and no later than 30 days from the date of contract conclusion, according to the methods chosen by the Buyer or indicated on the website at the time of the product offer.
5.2. If BLUEBEAR ITALIA Srl is unable to ship within the period specified in paragraph 5.1, the Buyer will be notified promptly via email.
5.3. The shipping methods, times, and costs are clearly specified on the website www.inbetweeners.io.
6. Prices
6.1. All selling prices of the products displayed on www.inbetweeners.io are expressed in Euros by default, but the Buyer can also view them in other selectable currencies on the website. These prices represent a public offer under Article 1336 of the Civil Code.
6.2. The selling prices include VAT and all other applicable taxes. Any additional charges (e.g., customs duties), if applicable, shall be borne by the Buyer.
6.3. The prices indicated for each product remain valid until the date specified in the catalog.
